A Missouri federal judge has ruled that the state must adjudicate a pro se complaint by Constance Kramer regarding the ability to identify that her vote was counted in both the 2022 and 2024 federal elections. The judge gave the lower court 90 days to complete the action. The elections division of Missouri was arguing the complaint came outside of the state election rules that require complaints to fall within 90 days of an election. The court pointed out that federal election law (The Help America Vote Act) states that complaints can be presented anytime the problem is identified without a timeline. The federal law supersedes state law regarding legal actions regarding federal elections.
